1 Introduction

These Terms and Conditions ("Agreement") constitute a legally binding contract between you ("the Member", "User", or "Player") and Fortuna33 ("the Platform", "we", "us", or "our"), an internationally licensed online gaming platform operating at the domain fortuna33.cam. This Agreement governs all access to and use of the Fortuna33 platform, including all games, betting markets, promotions, loyalty programmes, payment services, and any other features made available through this website.

By creating an account, logging in, or placing a wager on Fortuna33, you irrevocably agree to comply with and be bound by this Agreement in its entirety, together with our Privacy Policy and Responsible Gambling Policy, each of which is incorporated by reference into this Agreement. If you do not agree with any provision of this Agreement, you must not use the platform.

2 Definitions

For the purposes of this Agreement, the following terms shall have the meanings set out below:

• "Account" means the registered member account opened by a User on the Fortuna33 platform.
• "Balance" means the total of real-money funds credited to a Member's Account, excluding any bonus credits not yet converted through applicable wagering requirements.
• "Bonus Credits" means any promotional, welcome, reload, referral, or loyalty credits awarded to a Member, subject to applicable wagering requirements before withdrawal eligibility.
• "KYC" means Know Your Customer — the identity and age verification process mandated by the Platform prior to processing withdrawals or lifting deposit limits.
• "MYR" means Malaysian Ringgit, the primary currency of the Platform for Malaysian-based Members.
• "Platform" means the website, mobile interface, applications, and associated services operated under the fortuna33.cam domain.
• "Prohibited Activities" means any activity expressly forbidden under Clause 8 of this Agreement.
• "Wagering Requirement" means the minimum number of times a Bonus Credit amount must be wagered before it becomes eligible for withdrawal, as specified in the applicable promotion terms.

3 Account Eligibility

To be eligible to register and maintain an active account on Fortuna33, you must satisfy all of the following criteria at the time of registration and on a continuing basis throughout your membership:

1. You must be a natural person aged 21 years or older. This platform enforces a strict minimum age of 21 in compliance with the standards of our international licensing jurisdiction and Malaysian social norms regarding gambling activities.
2. You must not be a resident of any jurisdiction where online gambling is specifically prohibited by applicable law, including but not limited to the United States of America, the United Kingdom (without a locally licensed operator), France, or any other jurisdiction that has enacted specific prohibition legislation.
3. You must be acting in your own personal capacity, for entertainment purposes only, and not as an agent, employee, or representative of any other person or entity.
4. You must not be a current employee, contractor, or immediate family member of a household of any employee or contractor of Fortuna33 or its affiliated software providers.
5. You must not be listed on any government or regulatory watchlist relating to money laundering, terrorist financing, or financial crime.

4 Account Registration & KYC Verification

Each individual is permitted to register and maintain only one (1) active account on the Fortuna33 platform. The creation of duplicate accounts — whether under the same identity, shared device, shared IP address, or shared payment method — is a material breach of this Agreement.

During registration, you are required to provide accurate, current, and complete information including your full legal name, date of birth, residential address, email address, and contact number. You agree to update your account information promptly if any details change. Providing false, misleading, or incomplete information constitutes grounds for immediate account termination.

Prior to processing any withdrawal request, or upon the Platform's request at any time, you will be required to complete KYC verification. KYC documentation typically includes:

• A valid government-issued photo identification (MyKad, passport, or driving licence)
• Proof of current residential address not more than three months old (utility bill, bank statement, or official correspondence)
• Proof of ownership of the payment method used for deposits (e.g., screenshot of e-wallet account, bank account statement)

Fortuna33 reserves the right to request additional documentation at its discretion. Failure to provide requested documentation within the specified timeframe may result in temporary suspension of withdrawal privileges or account closure.

5 Deposits & Withdrawals

The Platform accepts deposits and processes withdrawals in Malaysian Ringgit (MYR) through the following verified payment channels: Touch 'n Go eWallet, Boost, GrabPay, DuitNow, FPX, Maybank online banking, CIMB Clicks, Public Bank PBe, Hong Leong Connect, and cryptocurrency transfers (BTC/USDT). The availability of specific payment methods may vary and is subject to change without prior notice.

The minimum deposit is RM 50 per transaction. Withdrawal minimums are RM 50, with processing times as follows:

• DuitNow / FPX / e-Wallets: typically 3–15 minutes during business hours
• Bank transfers (Maybank, CIMB, Public Bank, Hong Leong): up to two (2) business hours
• Cryptocurrency: subject to network confirmation times, typically 30–60 minutes

All deposits and withdrawals must use payment methods registered in the Member's own name. Third-party funding is strictly prohibited. The Platform reserves the right to return funds to the originating payment source if discrepancies are identified. Fortuna33 does not charge processing fees for standard withdrawals; however, certain payment providers may impose their own fees.

6 Bonuses & Promotions

Fortuna33 offers a range of promotional bonuses including welcome deposit bonuses, reload bonuses, cashback offers, referral bonuses, and VIP loyalty rewards. Each promotion is governed by its own specific terms and conditions, which will be clearly stated at the time the promotion is offered. In the event of any conflict between specific promotion terms and this Agreement, the specific promotion terms shall prevail for that promotion only.

Unless otherwise stated in the applicable promotion terms, the following general bonus conditions apply:

• Bonus credits must be wagered a minimum number of times (the "Wagering Requirement") before they may be withdrawn. Standard wagering requirement is twenty (20) times the bonus amount unless stated otherwise.
• Wagering contributions vary by game type: slots typically contribute 100%, live casino games typically contribute 10%–20%, and sports bets placed at odds below 1.50 typically contribute 0%.
• Bonuses are issued in good faith and are intended for recreational use. Any systematic exploitation of bonus terms — including but not limited to matched betting, arbitrage, or collusion with other players — will be treated as bonus abuse and may result in the forfeiture of bonus credits and associated winnings.
• Fortuna33 reserves the right to withdraw, amend, or cancel any promotion at any time without prior notice.
• Members are limited to one welcome bonus per household, device, and payment method.

7 Wagering Rules

All bets placed on Fortuna33 are subject to the specific rules of the relevant game or market. It is the Member's responsibility to familiarise themselves with the applicable game rules prior to wagering. Rules for each game are accessible within the game interface itself.

In sports betting, the following general principles apply:

• All bets are accepted at the odds displayed at the time of placement, subject to final confirmation by the Platform's risk management systems.
• In the event of an obvious error in odds (palpable error), the Platform reserves the right to void the affected bet and refund the stake to the Member's account.
• Live betting markets may be suspended or removed at any time without notice, particularly in response to significant match events.
• For Liga Super Malaysia, EPL, and other football markets, bets on abandoned or postponed matches are typically voided unless otherwise specified in the market rules.

For casino games, all outcomes are determined by certified Random Number Generators (RNG). Published Return-to-Player (RTP) percentages represent long-term theoretical averages across millions of rounds and do not guarantee individual session outcomes.

8 Prohibited Conduct

The following activities are expressly prohibited on the Fortuna33 platform and constitute a material breach of this Agreement:

1. Multi-accounting: Creating or operating more than one registered account, whether in your own name or using the identity of another person.
2. Identity fraud: Providing false identity documents, impersonating another individual, or using a stolen or borrowed payment method.
3. Collusion: Coordinating with other players to manipulate game outcomes, share hole card information in poker, or engage in chip dumping.
4. Automated betting: Using bots, scripts, artificial intelligence tools, or any automated software to interact with the Platform on your behalf.
5. Arbitrage and matched betting: Systematically placing offsetting bets to guarantee a profit regardless of outcome, in violation of the spirit of the promotional terms.
6. Money laundering: Using the Platform to deposit, layer, or integrate proceeds from criminal activity. The Platform cooperates with relevant authorities and is legally required to report suspicious transactions.
7. Unauthorised access: Attempting to access, probe, or interfere with the Platform's systems, databases, or source code.
8. Abusive behaviour: Harassment, threats, or abusive language directed at Fortuna33 staff or other users via any communication channel.

9 Responsible Gambling

Fortuna33 is committed to promoting responsible gambling practices. We recognise that while the majority of our members enjoy gaming as a form of entertainment, some individuals may develop problematic gambling behaviour. The Platform provides the following responsible gaming tools, all of which are available free of charge to every registered Member:

• Deposit limits: Daily, weekly, and monthly deposit limits, configurable by the Member at any time through account settings. Increases to deposit limits are subject to a 24-hour cooling-off period.
• Session time reminders: Configurable reminders that notify the Member when a specified session duration has been reached.
• Self-exclusion: Members may voluntarily exclude themselves from the Platform for a defined period (30 days, 90 days, 180 days, or permanently). Self-exclusion requests are irreversible for the chosen period.

10 Intellectual Property

All content on the Fortuna33 platform — including but not limited to software, design elements, graphics, logos, text, trademarks, trade names, game titles, and audiovisual content — is the intellectual property of Fortuna33 or its licensed content providers and is protected by applicable intellectual property laws. The "Fortuna33" name and logo are proprietary trademarks of the Platform.

Members are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial entertainment purposes. This licence does not permit you to:

• Copy, reproduce, distribute, or publicly display any Platform content without express written consent
• Modify, translate, reverse-engineer, or create derivative works from any Platform software or content
• Use any Platform content for commercial purposes, including affiliate marketing, without a signed affiliate agreement
• Remove, obscure, or alter any copyright, trademark, or proprietary rights notices on the Platform

11 Limitation of Liability

To the maximum extent permitted by applicable law, Fortuna33 and its directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Platform, including but not limited to lost profits, lost data, loss of goodwill, service interruptions, or computer damage.

In particular, Fortuna33 accepts no liability for:

• Any disruption to Platform services caused by internet connectivity issues, third-party payment provider outages, or scheduled maintenance
• Losses arising from the Member's failure to comply with any provision of this Agreement
• Losses arising from unauthorised access to a Member's account where such access resulted from the Member's failure to maintain credential confidentiality
• Any tax liabilities that may arise for the Member in their jurisdiction as a result of gambling winnings

The Platform's total aggregate liability to any Member in connection with any single event or series of connected events shall not exceed the total amount deposited by that Member in the thirty (30) days prior to the event giving rise to the claim.

12 Account Suspension & Closure

Fortuna33 reserves the right to suspend, restrict, or permanently close any Member account at its sole discretion, without prior notice, in the following circumstances:

• Reasonable suspicion or evidence of any Prohibited Activity as defined in Clause 8
• Failure to provide satisfactory KYC documentation within the requested timeframe
• Chargebacks or payment reversals initiated by the Member or their payment provider
• Breach of any provision of this Agreement
• Receipt of a request from a competent legal authority
• Account inactivity exceeding twelve (12) consecutive months

Upon account closure in circumstances not involving Prohibited Activity, any verified real-money balance will be returned to the Member via the last verified payment method used. Bonus credits, uncleared promotional funds, and any funds associated with an investigation into Prohibited Activity may be withheld pending review.

Members may voluntarily close their account at any time by contacting our support team. Voluntary closure requests are processed within five (5) business days. All pending withdrawal requests at the time of closure will be honoured subject to applicable KYC requirements.

13 Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Platform holds its international gaming licence. Any dispute arising out of or in connection with this Agreement that cannot be resolved through the Platform's internal complaints procedure shall be referred to binding arbitration under the rules of an internationally recognised arbitration body.

The Platform operates an internal dispute resolution process as the first point of contact for all complaints. Members wishing to raise a dispute should submit a formal complaint in writing to our support email address. We aim to acknowledge all complaints within 24 hours and resolve them within seven (7) business days.

14 Amendments to These Terms

Fortuna33 reserves the right to modify, update, or replace any provision of these Terms and Conditions at any time. Where changes are material — meaning they substantively affect Member rights or obligations — the Platform will provide a minimum of fourteen (14) days' advance notice via registered email address or a prominent notice on the Platform homepage.

Minor clarifications, corrections of typographical errors, or changes required by law or regulatory obligation may be implemented immediately without prior notice. The date at the top of this document ("Last Updated") reflects the most recent revision.

Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms and Conditions. If you do not agree with any amendment, you must cease using the Platform and may request account closure in accordance with Clause 12.
